Important Compliance Information Regarding the Methamphetamine Precursor Control Act

January 31, 2011 -- A recent review of the electronic pseudoephedrine
(PSE) sales logs revealed some pharmacies in Illinois selling packages
of PSE containing more than 3,000 mg (3.0 grams) of PSE per package. The
Methamphetamine Precursor Control Act, signed into law on January 15,
2006, limits pharmacies from selling any single package of PSE
containing more than 3.0 grams of pseudoephedrine per package. To
prevent pharmacies from being in violation of statutes, the National
Precursor Log Exchange (NPLEx) program is set up to block the sale of
any single package containing more than 3.0 grams of PSE.
Our
review revealed several pharmacies over-riding the “Stop Sale”
function, and completing the sale of packages containing more than 3.0
grams of PSE per package. Usually these are packages are those which
contain 15 - 240 mg PSE tablets (24 hour tablets) ensure compliance.
Legislation which affects the 3.0 gram sales limit: 720ILCS 648/25(b) Sec. 25. Pharmacies. (a)
No targeted methamphetamine precursor may be knowingly distributed
through a pharmacy, including a pharmacy located within, owned by,
operated by, or associated with a retail distributor unless all terms of
this Section are satisfied. (b)
Any targeted methamphetamine precursor other than a convenience package
or a liquid, including but not limited to any targeted methamphetamine
precursor in liquid filled capsules, shall be packaged in blister packs,
with each blister containing not more than 2 dosage units, or when the
use of blister packs is technically infeasible, in unit dose packets. Each
targeted package shall contain no more than 3,000 milligrams of
ephedrine or pseudoephedrine, their salts or optical isomers, or salts
of optical isomers.
